Driver Log Violations
Many trucking accidents are the result of driver fatigue and a failure to comply with state and federal regulations that dictate the number of hours a driver can legally operate a truck. Driver’s logs are necessary to document the number of hours that a driver with a commercial driver’s license has been behind the wheel. When there is an accident, these driver’s logs become critical evidence in determining whether a driver was in violation of the law.

Driver log violations and black box evidence
Unfortunately, many of these documents can be falsified. Our experienced trucking accident attorneys will aggressively investigate the documents and facts of your case to determine whether a driver or trucking company was in violation of a regulation or was fraudulent in creating a driver log. While a log book may track the number of hours that a driver claims to have driven, a black box will actually track the number of miles that a truck has traveled. If the log book does not correspond with the number of hours tracked in the black box, there is evidence that a driver may have falsified records.
Our attorneys will take the necessary steps to investigate your case and use creative strategies to advocate for you in and out of court.
Successful litigation involving driver log violations
One of the most critical steps in the litigation process is securing evidence after an accident. The earlier that you have a team involved in collecting evidence to document the facts of your case, the more likely it is that you will be able to succeed in court or in negotiations. Our attorneys will work with a team of experts to locate and preserve necessary evidence for your case and claim. Whether we are collecting driver’s log book records, contacting witnesses, or downloading data from a black box, we will aggressively go after the evidence we need. This evidence is critical for both the negotiation process and if we take your case to trial.
